Estimates and Pricing

All estimates provided by Elkins Earthworks, LLC are based on information available at the time of quotation and are subject to change without notice. Estimates do not include applicable sales taxes unless specifically stated. Additional shipping, freight, handling, fuel surcharges, or delivery-related charges may apply and will be added as necessary.

Order Acceptance

All orders are subject to acceptance by Elkins Earthworks, LLC. Pricing, availability, and specifications are subject to change without notice prior to order acceptance.

Shipping and Delivery

Unless otherwise specified by the customer at the time of order placement, shipments arranged by Elkins Earthworks, LLC will not be insured. Customers requesting shipment insurance must notify Elkins Earthworks, LLC before the order is processed. Risk of loss and damage transfers to the customer upon delivery to the carrier or upon receipt, as applicable.

Delivery dates are estimates only and are not guaranteed. Elkins Earthworks, LLC shall not be liable for delays caused by carriers, manufacturers, weather, supply chain disruptions, or other circumstances beyond its control.

Inspection and Claims Policy

Customer is responsible for inspecting all products upon receipt. Any shortages, damages, defects, or other discrepancies must be reported in writing within forty-eight (48) hours of delivery. Failure to notify us within this 48-hour period constitutes acceptance of the order as delivered, and no claims, adjustments, or returns will be accepted thereafter except as required by applicable law.

Payment Terms

Payment is due according to the terms stated on the invoice. Any invoice not paid when due may be considered delinquent.

Past-due balances are subject to finance charges at a rate of twelve percent (12%) per annum (APR), or the maximum rate permitted by law, whichever is less. Finance charges may accrue on outstanding balances until paid in full.

Credit Card Processing Fees

Payments made by credit card are subject to a four percent (4%) processing fee, which will be added to the invoice total where permitted by applicable law.

Returns and Cancellations

Returns and order cancellations are subject to approval by Elkins Earthworks, LLC and may be subject to restocking fees, freight charges, manufacturer return policies, and other applicable costs.

Limitation of Liability

To the fullest extent permitted by law, Elkins Earthworks, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the sale, delivery, use, or inability to use any products or services provided.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict of law principles.

Changes to Terms

Elkins Earthworks, LLC reserves the right to modify these Terms and Conditions at any time without prior notice. The current version posted on our website shall govern all transactions unless otherwise agreed in writing.
